1. Acceptance of These Terms

Welcome to 21 Moda. These Terms of Use ("Terms") govern your use of the online store located at https://www.21moda.com (the "Site") and any purchase you make through it. The Site is operated by 21 Moda, owned and operated by Juan Hernandez Sanchez, a fashion retail business based in Los Angeles County, California ("we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.

2. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new effective date. Your continued use of the Site after a revised version is posted means you accept the change. The effective date at the top of this page shows the current version.

3. Use of the Site and Eligibility

The Site is provided for your lawful personal use — browsing our collections and purchasing merchandise for yourself or as gifts. By using the Site, you represent that you are at least 18 years old, or that you are using the Site with the supervision of a parent or legal guardian, and that any purchase you make is for lawful purposes.

4. Customer Accounts

You may create an account to speed up checkout and track your orders. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current information and to update it as needed. We may suspend or close accounts used in violation of these Terms.

5. Products, Orders, and Payment

  • Order acceptance. All orders are subject to our acceptance and to product availability. Our inventory changes daily, and we may cancel or limit any order — including after an order confirmation is sent — if an item is out of stock, if we suspect fraud, or if a pricing or typographical error appears on the Site. If we cancel an order you have already paid for, we will refund that payment.
  • Pricing. Prices, promotions, and sale discounts may change at any time without notice. Despite our efforts, errors occur; we reserve the right to correct pricing errors and to cancel orders placed at an erroneous price.
  • Product display. We try to show our merchandise accurately, but colors and details may appear differently on different screens.
  • Payment. Payment is processed at checkout by third-party payment services — which may include Shop Pay, PayPal, Apple Pay, Google Pay, and major card networks (Visa, Mastercard, American Express, Discover, Diners Club) — through the Shopify platform. We do not store your full card number. You represent that you are authorized to use the payment method you provide.
  • Shipping. Orders ship via priority or first-class mail, with shipping fees calculated by item count as posted on our Shipping Info page. Delivery estimates (typically 5–7 business days from the date of order) are estimates, not guarantees, and we are not responsible for carrier delays. Risk of loss and title pass to you when we deliver the package to the carrier; tracking information is emailed when your order ships.

6. Returns and Exchanges

All sales are final, and we do not offer refunds or returns once an order has been placed and delivered, as stated in the returns policy posted on the Site. If your order arrives damaged or you receive the wrong item, you must contact us at 21moda@att.net within 48 hours of delivery, including your order number, a description of the issue, and photos if available. Approved exchanges are at our sole discretion, require the item to be unworn, unused, and with all original tags attached, and return shipping is at your expense. The returns policy posted on the Site at the time of your purchase applies to that purchase.

7. Intellectual Property

All content on the Site — product photographs, images, text, graphics, logos, and the design and arrangement of the Site itself — is owned by or licensed to 21 Moda and is protected by copyright and trademark law. You are granted a limited, revocable, non-transferable license to view the Site and to use it for shopping. You may not copy, reproduce, republish, scrape, or use any Site content for commercial purposes without our prior written permission.

8. Acceptable Use

You agree that you will not:

  • Use the Site for any unlawful purpose, including fraudulent orders or use of stolen payment methods;
  • Attempt to gain unauthorized access to the Site, other customers' accounts, or any connected systems, or probe or test their vulnerability;
  • Use robots, spiders, scrapers, or other automated means to access the Site or harvest product or pricing data;
  • Interfere with the operation of the Site or impose an unreasonable load on its infrastructure;
  • Impersonate any person or misrepresent your affiliation with anyone; or
  • Upload or transmit viruses or other malicious code.

9. Informational Purposes

General content on the Site — including style descriptions, sizing guidance, and availability or restock notices — is provided for convenience. We do not warrant that it is current, complete, or error-free, and it may change without notice. Nothing on the Site is professional advice of any kind.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS SECTION APPLIES TO THE SITE ITSELF AND DOES NOT LIMIT ANY NON-WAIVABLE WARRANTY OR CONSUMER RIGHT THAT APPLIES TO MERCHANDISE YOU PURCHASE UNDER CALIFORNIA LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 21 MODA, ITS OWNER JUAN HERNANDEZ SANCHEZ, AND ITS EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PURCHASE MADE THROUGH IT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless 21 Moda, its owner, and its employees and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

13. Third-Party Links and Services

The Site uses and links to third-party services, including the Shopify platform, third-party payment providers, shipping carriers, and our social media profiles on Facebook, Instagram, and TikTok. We do not control these third parties and are not responsible for their content, policies, or practices. Your use of any third-party service is at your own risk and subject to that party's own terms and privacy policy.

14. Termination

We may suspend or terminate your access to the Site or your account at our discretion, without notice, for conduct that violates these Terms or that we believe harms us, the Site, or other customers. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms, the Site, or a purchase made through the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and the shipping and returns policies posted on the Site, are the entire agreement between you and us regarding the Site. We may assign these Terms; you may not. Section headings are for convenience only.
